ERISA, a federal law, governs most disputes over long-term disability insurance policies acquired through an employee benefit plan, while state contract and tort laws govern disputes over private disability insurance policies.
ERISA allows those who have been denied long-term disability insurance benefits to appeal to federal court in the United States District Court, District of Montana, with courthouses in Billings, Butte, Great Falls, Helena, and Missoula. Cases are divided between those courthouses based on litigants’ locations. If successful, ERISA appellants may recover contractual damages, back and future benefits, as well as interest and possibly attorney fees and costs.
